Hang Dallas operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, our community of artists, collectors, and curious-minded people, with a place to discover, buy, and learn about art (the "Services"). Hang Dallas is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, attend our events, become a member, or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

  • Artist Service information if you are a member artist using our business services, including pricing decisions, social media account access (where you authorize it), sales records of work you sell through Hang Dallas, and content you submit for promotion.
  • Device information including information about your device, browser, or network connection, your IP address, and other unique identifiers.
  • Usage information including information regarding your interaction with the Services, including how and when you interact with or navigate the Services.
  • Image and likeness including photographs or video recordings taken at Hang Dallas events that may include your image. See "Events and Photography" below for details.

We may collect personal information from the following sources:

  • Directly from you including when you create an account, become a member, RSVP to or attend an event, communicate with us, or otherwise provide us with your personal information.
  • Automatically through the Services including from your device when you use our Services or visit our website, and through the use of cookies and similar technologies.
  • From our service providers including Shopify, our subscription billing partner, our email service provider, and other vendors we engage to provide functionality on our behalf.
  • From our community platforms such as Slack, where you may post information that becomes available to us and other members.

How We Use Your Personal Information

Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:

  • Provide, Tailor, and Improve the Services. We use your personal information to provide you with the Services, including processing payments, fulfilling orders, sending notifications related to your account or memberships, managing your membership benefits, organizing and running events, and creating a customized experience for you. This includes using your personal information to better tailor and improve the Services.
  • Membership Billing. We use your payment information to process recurring subscription charges for your membership and to handle cancellations, renewals, and refunds.
  • Marketing and Advertising. We use your personal information for marketing and promotional purposes, such as to send you event announcements, newsletters, and related communications by email or text message, and to show you online advertisements for our events, programs, or services. You can opt out of marketing communications at any time using the unsubscribe link in any marketing email.
  • Event Promotion. We may use photos and recordings from Hang Dallas events on our website, social media, and other marketing materials to promote future events. See "Events and Photography" below for your rights and options.
  • Artist Services. If you are a member artist who has engaged our business services, we use your information to manage the services you have requested, including social media management, sales facilitation, business strategy sessions, and the promotion of your work.
  • Security and Fraud Prevention. We use your personal information to authenticate your account, provide a secure payment and shopping experience, detect and prevent fraud, and secure our Services.
  • Communicating with You. We use your personal information to provide you with customer support, respond to your inquiries, and maintain our relationship with you as a member, customer, or community participant.
  • Legal Reasons. We use your personal information to comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies, and to enforce our terms or policies.

  • With Shopify and our subscription billing provider for payment processing, account management, and other essential e-commerce and subscription functions.
  • With vendors and service providers who perform services on our behalf, including email service providers, IT and cloud storage providers, payment processors, event management tools, social media management platforms, and analytics providers.
  • With our community platform provider (currently Slack) for the purpose of operating the member community channel.
  • With business and marketing partners to provide marketing services and advertise to you. Depending on where you reside, you may have a right to direct us not to share information about you to show you targeted advertisements.   • When you direct, request us, or otherwise consent to our disclosure of certain information to third parties, such as through your use of social media widgets or login integrations.
  • In connection with a business transaction such as a merger or sale of assets, to comply with any applicable legal obligations (including to respond to subpoenas, search warrants, and similar requests), to enforce any applicable terms of service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.

Subscription Billing and Membership Data

Hang Dallas offers memberships ("Regular Hangs" and any future tiers) that are billed on a recurring basis. When you sign up for a membership:

  • Your payment information is processed and stored by our subscription billing partner. We do not directly store your full payment card information.
  • Your membership status is tracked in our systems for the purpose of providing member benefits, sending renewal reminders, and processing cancellations.
  • After you cancel a membership, we retain your account and billing history for a period required by tax, accounting, and legal obligations (typically seven years for financial records), even if you no longer have an active membership.

Events and Photography

Hang Dallas hosts in-person and online events including pop-up shows, lectures, member gatherings, and workshops. When you attend a Hang Dallas event:

  • We may collect your name and contact information through RSVP forms for the purpose of managing attendance, sending reminders, and following up about future events.
  • Events may be photographed or video recorded. Images and recordings may include your likeness and may be used by Hang Dallas for promotional purposes, including but not limited to our website, social media accounts, marketing materials, and future event announcements.
  • You may opt out of being photographed. Please notify us in writing before the event (at jorge@hangdallas.com) or speak with a Hang Dallas representative on-site. We will use reasonable efforts to honor opt-out requests.
  • If you are pictured in an event photo or recording and would like it removed from our marketing materials, please contact us and we will make reasonable efforts to remove it within a reasonable timeframe.

Community Channels

Members of Hang Dallas have access to a private community channel (currently hosted on Slack). When you join the community channel:

  • The community platform provider has its own privacy policy that applies to your activity on that platform. We recommend reviewing it.
  • Information you share in the community channel (messages, profile information, posted content) is visible to other members and to Hang Dallas administrators.
  • We may use community channel content to inform our programming and member experience, but we do not share private messages outside the channel except as required by law or as necessary to operate the community.
  • When your membership ends, your access to the community channel ends, but content you previously posted may remain visible in the channel's history.

Artist Services

If you are a member artist who engages Hang Dallas for business services (including but not limited to social media management, sales facilitation, business strategy sessions, or featured artist promotion):

  • We collect additional information needed to perform those services, which may include access credentials for social media accounts you authorize us to manage, pricing decisions for your work, sales records, and biographical and professional information for promotion.
  • We treat artist business information as confidential and use it only for the purpose of providing the services you have requested.
  • We may need to share certain artist information with third parties to perform services (for example, sharing your work with potential collectors, or accessing your authorized social media platforms). We do this only as necessary to perform the services.
  • If you cancel your membership or terminate Hang Dallas services, we will return or delete artist-specific information upon request, subject to our legal record-keeping obligations.

A separate Artist Services Agreement may apply to specific artist engagements and will control over this Privacy Policy with respect to data handling specific to those services.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes. Children's Data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children under the age of majority in your jurisdiction. As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 16 years of age.
